EU trademark search

In order to avoid refusal to register a trademark in the EU, before filing an application it is necessary to undergo a preliminary search procedure for similarity and identity with previously registered or applied for registration in a specific class(es) of trademarks. The search is carried out not only in the EU trademark database, but also separately in the TM registers of each EU member country.

This verification avoids the risk of refusal by one or more EU Member States. Since, according to the legislation of the European Union trademark, if one country of the Union does not agree with the registration, then the entire EU trademark is canceled. This application can be converted and submitted with priority to each participating country separately, but this will be a waste of time and money.

The official EUIPO fee for trademark registration is:

• 850 EUR in 1st class;
• +50 EUR for additional 2nd class;
• +150 EUR for the 3rd and each subsequent class.
